Keith Peck, Esq.

Keith H.S. Peck is a legal warrior. For nearly three decades, he has waged war against school districts and state agencies that fail children with disabilities. With well over 1,000 cases filed under the Individuals with Disabilities Education Act, or Section 504 of the Rehabilitation Act, he is one of the most battle-tested special education litigators in the country. He does not negotiate from weakness. He does not back down. He wins.


His battlefield victories speak for themselves. In Doug C. v. Hawaii Department of Education, he forced the Ninth Circuit to establish a new bright-line rule for judging procedural compliance with the IDEA. He served as co-counsel in Hawaii’s special education class action and as original lead counsel on Hawaii’s Olmstead action. He helped establish a right to money damages under Section 504 in the Ninth Circuit in Natalie and Michelle H., et al v. Lemahieu, et al. He has served as lead counsel in over 100 United States District Court cases involving IDEA and constitutional issues. Hearing officers and federal judges know that when his name is on a filing, the fight will be relentless.


Beyond the courtroom, Keith co-developed the 2014 American Bar Association’s continuing legal education seminar for advanced IDEA practice. He has mentored attorneys, conducted thousands of consultations for families. He has advised for-profit and non-profit boards on programs serving children with autism spectrum disorder and other disabilities. Keith is not the attorney you hire to play nice.
